Constitutional petition on abolition of KCC referred to formal review
SEOUL, Oct. 17 (Yonhap) -- A constitutional petition filed by Lee Jin-sook, former chair of the Korea Communications Commission (KCC), to challenge the legality of a new law that dismantled her commission has been referred to a formal review by the Constitutional Court, judicial officials said Friday.
The Constitutional Court decided Wednesday to hold a formal review on Lee's petition, which was registered on Oct. 1 following the enactment of the government reorganization bill that abolishes the KCC, the state telecommunications regulator, and establishes the Korea Media and Communications Commission (KMCC) instead.
Lee, who was automatically removed from her KCC post with the launch of the KMCC on Oct. 1, insists in the petition that the new law infringed on her right to equality, right to pursue happiness and right to hold public office by shortening her legally guaranteed term.
Lee was appointed by former President Yoon Suk Yeol in July 2024 to a three-year term.
As the Constitutional Court has accepted Lee's petition, a three-justice panel will first conduct a preliminary review. If the petition is deemed legitimate, it will be forwarded to the full bench of nine justices for a formal deliberation.
